Legal Question in Immigration Law in Washington

Need to Travel

My US citizen husband and I married 6 months ago. We have filed all the necessary documents, as well as the I 131 for my travel needs, which I have obtained. We have not had any inteview, as well as any other documents besides my I 131 and my EAD that I will receive in a week. I need to travel very soon, but, I am afraid of not being able to come back to the US. Is my french passport and my I 131 enough to travel out of US?

Assuming that you filed a complete application for adjustment of status and that you are eligible to adjust, you should not have any problems traveling on your french passport (the travel document from your country) and the approved advance parole (which gets you back IN to the U.S). If you leave without the advance parole, INS will assume you want to abandon your application. Does this help? If you can prove that there is a truly urgent need (letter from a hospital, etc.) you might be able to get your advance parole - also known as a travel document - a little faster. Good luck.

P.S. I do think that it might be a good idea to have a copy of your application reviewed by an immigration lawyer to be sure that you did complete it accurately and correctly and that you included everything necessary.
