Legal Question in Employment Law in Washington
Background Checks for Employment and Juvenile Adjudication
my son has an offense as a juvenile in which he was not convicted of the crime but was adjudicated of the offense. Is he required to disclose the information on a job application that states:
Criminal Record Information
Any conviction that has ever occurred, you must disclose all information including; state, county, dates, crime type and disposition.
About the Criminal Record Information - Under your current name or any other name, have you ever entered a plea of guilty or no contest or otherwise been convicted of a misdemeanor or felony offense against criminal, civil, or military law; or are you currently under charges (including deferred sentences or deferred prosecutions) forany offense against criminal, civil or military law? A conviction record will not necessarily bar you from employment however, if you fail to disclose your criminal history completely and accurately, you will be disqualified.
Offense occurred in Tennessee, job prospective is in the state of Washington...

Re: Background Checks for Employment and Juvenile Adjudication
Dear Sir/Madam:
Based on the facts you have presented, it appears that you are asking whether or not your son must disclose a juvenile criminal record, although he was not actually convicted. The job application you stated above tends to lean more towards the issue of conviction or current charges.
You may wish to seek the assistance of an attorney on this matter for further review.
Thank you.
Respectfully.
