Legal Question in Employment Law in Washington

Boss is holding my check.

I recently quit my job due to some really bad work conditions. Now my old boss called me and said sense I decided to quit she is holding my check until tonight when all the banks close. Now she knows her checks are bad so I can't cash my check anywhere else cause if I put it in my bank tomorrow her check will bounce. So my question is By law do I have to wait to get my check when she wants to give it to me?

Re: Boss is holding my check.

By law, she has to pay you on the next regular payday. If today is the next regular payday, she has to pay you today.

If the check bounces (sounds like it would be wise of you to prepare for that possibility), she has not paid you. You can contact the Department of Labor & Industries (that's correct; they do more than handle injury claims) for help. Or you can take her to small claims court.

Depending upon what the really bad working conditions are, you might also qualify for unemployment compensation. Check with Employment Security.

Good luck!
