Claiming Management for Gain after a Layoff
Hello,
I was laid off as a member of senior management in a mid-sized design/marketing firm in Seattle, due to the high-tech downturn and the firm's poor financial performance. That was several months ago, and the firm still claims me as a member of management on their web site, including my photo and bio, information about a book I wrote and published with a separate publisher, and even suggesting that potential partners contact me directly at the firm.
In essence, the firm is benefiting from my contributions and achievements while fraudulently representing my presence. I do not have an email account with the company, and have had no professional contact with them since about a week after I was terminated.
Is this fraud? Should I seek to be compensated for damages by them using my name for their gain without consideration for me? I was given no severance pay, and actually had to chase after bonus money owed to me. At the very least, what do I do to get them to remove my name from their site, and to stop claiming my existence and capabilities if I'm not there? Without me, they have no capabilities in my area of expertise.

Send them a letter stating you want your name taken off the affiliation with the firm and that you have contacted a lawyer to compel them to do so if its not resolved in one week.
