employee insurance benefit

I have 6 employees.

I pay half of payment for 4 of them.

One of the six chooses to not participate. He can't afford it.

One is retired military and is covered.

Four are receiving a benefit the other two are not.

Do I have any obligation to the two who choose to not participate.

That's a good question, and I'm afraid I don't know the answer without doing substantial research. If it was me, I'd start by doing two things:

(1) Have each of the employees who choose not to participate sign a waiver.

(2) Contact the Insurance Commissioner's office in Olympia and see if there's someone there who can help you figure out the right answer to your question.

Meanwhile, I'll assume that you are paying for Workers' Comp for them, and that you're talking about health insurance.
