Legal Question in Employment Law in Washington

emplyment

I am a twenty year old cook in a local restaurant. My boss seems to have something against me for whatever reaseon. He continually makes comments on my age, comments on myliving situation(living with my parents for a short while),today said to another employee ''it's like talking to an eight year old''.At one point he snuck up behind me and screamed at me for doing something incorrectly even though I had worked there only three weeks causing me to panic and have chest pains. He is also paying more money to another employee who does half the amount of work that I do.Is this treatment wrong??

Re: emplyment

To answer the question that you asked, yes, your boss' behavior is wrong. Very wrong.

To answer the question I think you meant to ask, no, your boss' behavior is probably not contrary to law. It would be illegal if he is were acting on a bias against you because of an illegal reason. This could be because of your membership in a protected group (race, national origin, marital status, sexual orientation, etc.). Another illegal reason could be retaliation for exercising your statutory rights (such as filing an L & I claim after a workplace injury.)

You may be wondering, "Isn't age discrimination also on that list?" It is, but unfortunately for your case, age discrimination is defined in the law as discrimination against someone for being age 40 or older.

Do the best you can, keep reminding yourself that your boss is the one with the problem, and hang in there while you look for a better job.
