Legal Question in Employment Law in Washington

Failure to provide a copy of compensation agreement

If an individual is hired by an employeer for a commision only position is the employeer required to give the individual a copy of the compensation agreement? In other words, must the employeer provide the employe with a copy of the agreement? If the employeer does not provide a copy of the contract and upon verbal request fails to provide the employe with a signed copy of the contract is the employeer in violation of any Federal or Washington state laws?

Re: Failure to provide a copy of compensation agreement

Generally the employer must provide access to the personnel file upon request. This certainly seems like it should be in the personnel file. I would call the WA dept. of Labor and Industries with this question. You could also hire a lawyer to look into it and to try to get a copy, but it might provoke a bigger problem with the employer, and would only become worth it if you think you are being ripped off for significant amounts of money. This is a lesson about asking for a copy of the agreement as soon as you sign it. I am definitely very uncomfortable with an employer who intentionally will not give a copy of a document the employee signed for them.
