Legal Question in Employment Law in Washington

questioning sick leave

A union employee was sick and called in to say she wasn't coming to work..The ''supervisor'' asked if she really was that sick so employee came to work...before she arrived, a ''manager'' called her home and did not identify herself and when asked who was calling..said ''I am her boss''...I thought questioning or doubting a persons reason for illness was illegal, and could be open to litigation. The individual has not been an abuser of sick leave, but she is a US Citizen who immigrated from Malaysia.

I am a librarian and have checked many sources, but really hope you can answer my question or guide me to a source that would help me.

Re: questioning sick leave

Questioning or doubting that a person is sick is not illegal.

Questioning or doubting a person from Malaysia is illegal if American-born employees are not treated this way.

For more information, contact the WA State Human Rights Commission and/or the Equal Employment Opportunity Commission.

Good luck.

Merry

PS Review the union agreement and see if that was violated.
