Legal Question in Employment Law in Washington

Am I required to stay at work once I'm off?

Is it legal for my boss, at a retail store, to require me to stay past the time I am scheduled to be off? The store was closed and the doors were all locked and I couldn't leave until she felt the store was looking good enough and then she had to unlock the door to let me out. Legally, can she force me to stay past the time I am supposed to be off? What can I do next time she does this?

It depends on what you mean by "require".

Generally, it is legal for an employer to discipline employees who are insubordinate and refuse to work additional time beyond the scheduled time. The extra time must be compensated and must not violate any other work laws {e.g. Family Medical Leave}

An employer should never physically restrain or imprison the employee by locking the doors and refusing exit. If this occurs, the employee may file suit under a tort theory of false imprisonment to recover any monetary damages or damages resulting from emotional distress. The employee could also file criminal charges against the employer and the individual responsible.

Consult an attorney for additional information. The above advise is intended to be general in nature and is not meant to replace individual consultation with an attorney.
