Legal Question in Employment Law in Washington

resign or be terminated?

Is it better to resign or be terminated? Car accident forced me to take medical leave. I am well beyond the fmla.

I'm not physically able to work full time so I assume unemployment benefits are out. Part time work at my current job has flared up my injuries. Unable to work part time.

I think I may qualify for SS Benefits although I have read that over 60% are denied.

What are my options? Should I resign or be terminated? I don't know what is best to do for my situation.

I do appreciate my employer's patience and flexibility but I need to move on and am stuck on what I should do and what the laws are.

Thank you!

Re: resign or be terminated?

If you want to work somewhere else in the future, it's better to resign.

Most people ARE denied for disability benefits. Then they hire an attorney, who appeals, and there's no charge to the client. Clients often win on the appeal.

Are you entitled to disability retirement? Do you have disability insurance? If the answer to either is "yes" you'll at least have some money coming in for a while.

I am sorry about your accident. The attorney helping you with your car accident can probably answer some of your questions.

Sincerely,
