Vacation Time

I live in Seattle and work out of a home office, my corporate office is in NJ. I have worked for my company for four years and have not taken vacation. They recently informed me that if vacation time was taken then it was lost. I have never recieved an employee manual stating this nor have they ever notified me that I had vacation hours that wouold not be carried over.

Can they simply not pay me for vacation hours?

In Washington, there is no legal requirement that the employer provide vacation time. Depending on the facts of your case, you might be able to make an argument in court that they had promised a certain amount of vacation and were contractually obligated to permit it, but that argument is very fact specific and probably does not have a lot of traction in any case. Unfortunately, there is no statute that we can point to and say definitively, "Vacation pay is required in this case."

It does not sound very fair or just, but it probably is legal, I'm afraid.
