wrongful termination

can i be terminated because a fellow employee alledged they smelled alcohol on me. even though i was taken in for testing and the results came back negative?

You can be terminated for any reason or for no reason at all, so long as it is not an illegal reason.

What this means is that if your employer terminates you for being intoxicated on the job, even though tests came back negative, you do not have a case against the employer unless you can show that the intoxication claim was pretext for some other illegal reason, such as age discrimination. It is possible, however,that you would have a defamation claim against the employee who lied about you. I would need for information to say for sure.

Is that just and fair? No, of course not, and I sympathize with your predicament. But, for some injustices, there is no remedy at law, unfortunately.
