Apartment and Car

I recently moved out of my apartment. The manager knew I have been out of work for 3 months due to undiagnosed illness. I also have a couple of cars. After moving out and leaving house keys I asked them not to tow my cars that I will remove them as soon as I could. She gave me the weekend. I removed the one in the reserved area but needed more tools for the other one. They told me it wasn't a big deal because it was out of the way. Monday night two friends and I checked it to see if it was tagged to be towed and it wasn't. They towed it the next afternoon. They say they got complaints that weekend. No note yet they claim they put one on it (LIE!). I didn't find out until wednesday evening when i went to go get it. When I found out and called the towing company it was $570 and growing $60 by the day. How do I get my car back and isn't that theft without notice? Can they tow any car without notice resident or not?

File a request for a towing hearing. Go to the towing yard, they will have the correct form and will file it with the nearest District Court.

You are contesting the validity of the tow.

It is very useful to have pictures for the court to review of where the car was parked and whether or not there were any signs visible telling you this was private property and that your car could be towed.

The person who authorized the tow has to show up and explain the basis for the decision to tow. If the property was posted you are probably out of luck. Also, if you had a rental contract, see what that says about where you can park and for how long.
