Legal Question in Landlord & Tenant Law in Washington
Background checks and diversion programs
Nearly three years ago i was charged with a felony pot charge and ive been in compliance with a diversion program i was placed on since. Im trying to find a nice apartment community to live in but im worried that my charge will prevent me from getting into the place i want to be. will this be a problem? Will this show up on their criminal background checks?

Re: Background checks and diversion programs
It depends. If you are in complete compliance with the terms of the diversion order, the matter should be dismissed without a finding of guilt, which means it never happened.
In order to determine if this is the case, go back to that court and ask the clerk to let you see the file.
You can also contact the Washington State Patrol to see what they have on file and make sure it is accurate. WSP is the agency that maintains criminal records histories. There is a form you can access on line, but if you go in person to the WSP offices in Olympia, they will have a different form there that you can use to request your history and ensure that it is accurate.
Good luck with this. If the diversion program worked AND you have done everything the court requested, it should dissappear from your permanent record and not be an issue when you go to rent an apartment.
