Re: How do I break my lease legaly

Depends on what your lease says. If it is a month to month, you give written notice on or before the tenth of the month and that notice is effective at the end of the month.

Read your agreement carefully.

Judges will generally require landlords to mitigate their damages by re renting the property to another tenant, and usually don't enter a judgment against a breaching tenant that is greater than one month's rent and possibly attorney fees and costs.

Landlords usually just want the place back intact. Also, you can bargain with the landlord directly.

Gonzaga Law School may be able to help you, and if not, contact your County Bar association for a referral or a clinic so you can go over this with an attorney.

Hope this helps. Elizabeth Powell
