how do I get out of a commercial lease?

I have 3yrs remaining on a commercial lease,in a strip mall. It is priced well over the market value. The business next door is a restaurant. I would like to get out of the lease. The landlord will accept a sublessor, however not in the food industry. That is the only interest I've had in a space this size ~3000 sq ft. Do I have any other options for getting out?

You could go talk to your landlord and ask if you both can enter into a mutual recission of the lease agreement. Alternatively, you could ask your landlord if he will renegotiate the rent. Or, you can find a suitable sublessor for the space. What happens here is ultimately under your landlord's control, and the outcome will depend on the landlord's reaction. Commercial unlawful detainer is even harsher than residential and if your landlord brought an unlawful detainer against you for non payment of rent,you could wind up owing him ALL the rent due under your lease and his attorney fees and costs. He can take a lien on your personal (business) property for the value of two month's rent. Please proceed carefully. Good luck - Powell
