Legal Question in Landlord & Tenant Law in Washington
Eviction for Noise Complaints
If I get evicted on having too many noise complaints, do I get my last months deposit back that was already prepaid, if I am give 20 days, which would basically be the months rent already paid? Also how does an eviction for noise complaints effect my rental history? Does that mean no one will rent to me like being evicted for not paying?

Re: Eviction for Noise Complaints
Getting evicted for noise complaints would be a real trick. The case on point is Tarr v. Hopewell Community Club, in which a social club (e.g. a speakeasy) was determined not to be making enough noise to warrant eviction.
Whether or not you get your deposit back depends on what the contact says about what the deposit was for. Generally, it is a security deposit (to secure all your obligations) or a damage deposit - which is purely about the physical condition of the premises at the time you leave. Arguably if you allow these people to tell you that they get to keep your deposit because you breached your duty to not make too much noise, then they could feel entitled to keep your deposit.
If you pre paid your last month's rent be sure that your landlord knows you are exercising your decision to make this month your last month.
An eviction on ANY grounds will sit on your credit history for ten years. The report will not detail why you were evicted, just that you were evicted. Much better practice not to let it get to this point.
Hope this helps. Elizabeth Powell
