Legal Question in Landlord & Tenant Law in Washington
Judgement
I have a collection agency trying to collect a debt about 5 years old. I sent them a follow-up letter on August 19, 2006, asking them to validate the debt. This was my second letter to them asking for this information. I want to pay the debt if it is owed. The statue for me to challenge the debt expires on 2/1/2002, six years. I am not sure what to do next?

Re: Judgement
It is hard to answer your question without some context, so I am going to give you some generalities, and see if it helps.
Actions to enforce a written agreement have a six year statute of limitations in WA. If the debt has not been reduced to judgment within six years the statute has run and the debt is no longer collectable.
Actions on an oral contract have, effectively, a three year statute of limitations.
If the debt was reduced to judgment within the last ten years, the judgment is enforceable and collectable. If they cannot sieze any of your assets to collect the judgment in 10 years, they can apply to renew the judgment for another ten years.
If they have asked you, and you have properly requested that they validate the debt, twice, and they have not responded, you did it just right.
Collection agencies usually are attempting to collect debts that are not reduced to judgment - but I cannot tell from your question.
Debt gets sold for pennies on the dollar, and they keep attempting to convince the person they think owes money to pay the new creditor.
If you want to settle with them remember that. Good luck! Powell
