Legal Question in Landlord & Tenant Law in Washington
Landlord not applying Last Months Rent
The lease for me and my sister is up at the end of April. On the first of April, we gave them a written notice that we intend to vacate. Come the sixth, we recieve a notice that our Last Month's Rent was not being applied, and so we owed another months of rent, which was deemed already late (with a one day grace period to pay without incurring late fees). Their reasons for this are as follows:
We did not schedule, prior to the 5th, an appointment in which they and we would do a walkthrough of the apartment to examine it's condition before the end of the lease.
After a recent inspection, they deemed our apartment smelled slightly of cat. A little background on this. Two weeks ago, the apartment complex was given an annual inspection. They learned that we had a cat against the lease. As such, we were given a 10 day notice to either remove the cat and pay 400 dollars or vacate. We did the former.
The final reason they decided to not apply our last month's rent is because our apartment was a little cluttered.
They have given us only a three day's notice to either pay the rent or vacate. This notice is only in regard to having not paid this rent we supposedly owe.
Do they have the right to not let us use our last month's rent?

Re: Landlord not applying Last Months Rent
This is my THIRD attempt to give you an answer. The BBS is not allowing me to get through - apparently no phone numbers and my answer cannot exceed 3000 characters, but they don't tell you that until AFTER you have submitted a carefully tailored essay.
Please just call me I will explain this and help you. Presuming you can prove with documentary evidence that you have pre-paid your last month's rent you have nothing to fear from that 3-day. You gave your notice on time.
