Legal Question in Landlord & Tenant Law in Washington

Is new landlord bound by old lease?

I live in subsidized housing in Washington state. I have a lease that expires at the end of February. The property, which consists of two complexes, is being sold. The owners want to remodel my apartment and others and have told us that we need to ''transfer'' to the other complex in December. They have units available. Do I have to move before my lease is up?What are my rights?

Re: Is new landlord bound by old lease?

It depends on what your lease says and whether your subsidy is through Section 8 or HUD.

If it was not subsidized housing, you'd go look at RCW 59 18 to determine what you can and can't do.

Landlords are required to maintain their housing. Seems like it is a bit of a stretch to require you to relocate while maintenance is going on. That is asking a lot. Have they notified you in writing of what they are asking? More critical, have they told the housing authority?

I'd suggest that you contact your housing worker at the housing authority - in writing - and request a hearing to determine whether you have to comply with the owner's request, and also to determine how you are going to be compensated for the work involved in a temporary move.

Gonzaga Law school has a housing law clinic. You can find them through Google. They can help you, if necessary. Hope this helps. Elizabeth Powell
