Tenant Smoking
Hello. I am a tenant in an apartment complex and the tenants are not allowed to smoke. However, the person below us smokes constantly and it seeps into our place. We reported it to the manager and he defended her saying that ''it was her porch'' so it was okay, though it clearly states on a sign outside the complex ''NO SMOKING''. We constantly have to keep our windows closed and that is a problem during the summer. So now we have to endure the acrid smells of the tobacco if we want to open the windows to try and stay cool. If it is stated in the contract and in front of the apartment doors that there is no smoking, it shouldn't matter where she does it if it is on the aparment property right? It is still breaking the rules. Please help. Thank you!

Your option is to be sure that you have given notice to your landlord in writing (phone calls and / or personal conversations do not count) and give notice that you are out on or before the tenth of the month.
At the end of the month, be out. Be sure the owner of the complex knows why you are moving.
