Legal Question in Landlord & Tenant Law in Washington

unconcionable contract?

i live in apartments on a month to month basis. I was notified about 3-4 weeks ago that our apts had been sold to condos and that we would be allowed to buy our apt or make other living arrangements. I chose to make other arrangements. I gave notice on the 10th of feb saying I would be out by the 1st of march. They came back with ''no, you have to pay for march rent because you didnt give 20 day notice because their is only 28 days in feb.'' They also refuse to prorate any time in march, I offered to pay for a few days in march, they said no. So now I am stuck. I had a contract with the old owners, not these people anyway, and they told me to make a choice. I made one. Can they legally charge me for March?

Re: unconcionable contract?

My sympathies on your conversion, that's awful!

And to add insult to injury, there aren't 20 days in February after the 10th, only 18 days.

I agree with you that their response is a bit harsh.

You have all ready told them you will be out Feb 28th. Just do it, then.

If they choose to file suit against you for the March rent, they can 'splain to the court their conversion, your decision, your offer and their refusal, and they are going to look like chumps.

No reputable attorney is going to sue over one month's rent when possession is not at issue.

Hope this helps. Powell
