Legal Question in Legal Ethics in Washington
If an employee has a personal conversation between her and her Director containing derogatory statements about two fellow managers and leaves the email open and maximized on her screen (that faces the opening of the office where others walk by), and the two Managers see the email, are the two Managers at fault for reading it? Or are the employee and Director at fault for making derogatory statements about the two others on company email and not protecting the information? The email was in plain view of the office door where others walking by can visibly see.
