Legal Question in Medical Malpractice in Washington

Insurance after Dr retires

I am contemplating suing a Doctor for Malpractice, I am in the 3 year statatory limit but I was told that the Doctor has retired from his practice. Will this affect my being able to sue him?

Yes you can sue a doctor even if he's retired. He's likely covered with supplemental malpractice insurance. However, the statute of limitations will still apply to your causes of action against him for all of your damages so you should move rapidly before your time is up.

If the doctor had insurance at the time of the alleged malpractice, it will likely cover him. Please feel free to contact me if you have any other questions.
