Legal Question in Medical Malpractice in Washington

medical malpractice

Can I be held personally liable for medical malpractice if a claim / judgment exceeds my insurance limits in Washington State. If I incorporate or form an LLC and operated my practice as either a corporation or an LLC will this protect me?

Doctor: The answer to your question is sufficiently important to your financial well-being that I would urge you speak in person with a competent lawyer who is conversant in this area of the law. There are likely lawyers in the Seattle area who specialize in representing medical professionals in just your area of need. You might try contacting the Washington State Bar in Olympia or the King County Bar Ass'n for a referral, unless your inquiry online nets you a good candidate.

Sorry I can't be of greater help, but there are many other questions that ought to be answered before suggesting what business form your practice should take. As a plaintiff's lawyer, however, the BEST answer is to buy HIGH LIMITS of malpractice insurance -- as much coverage as you can buy to protect yourself.
