Legal Question in Medical Malpractice in Washington

statute of limitations for surgical malpractice

3 years ago I had back fusion surgery. I was told the metal

that would be used in implanted screws would be titanium.

Instead, surgical steel screws were used. I have had

ongoing severe pain and now have symptoms of metal

posioning. I may be allergic to surgical steel. In essence

because I had given consent only for the use of titanium, I

feel I was not given informed consent. The screws now have

to be removed. What is the statute of limitations for this.

Can I still pursue this matter l

Generall speaking there is a 3 year statute of limitations in Washington. If you have a hidden issue as your's, then it's one year from the date of discovery to file suit against all potentially liable entities and persons.
