Legal Question in Military Law in Washington

Admin. Sep

I had an investigation against me, where there wasn't any evidence to prove me guilty. I told the Captain I wanted off the ship, but he won't let me. He said I need to prove myself first and since I have went to Captain's Mast before, I didn't get the benifit of the doubt. He told me that I either play for his team or there are going to be problems, talking about admin sep. If I do get admin sep, does that effect me getting a job once I get out? How bad is Admin sep. Lastly, since I was found innocent and want off the ship due to question of character reasons, does he have the right to deny it?

If you are administratively separated due to misconduct, the discharge may be characterized as "other than honorable." That might prevent you from getting some jobs, particularly government jobs. It also takes away your veterans benefits in most cases.

You don't have a say in when and where you are assigned. Only the Captain can approve your transfer before the end of your tour or the end of your enlistment. Thus he can deny your request to transfer from the ship.
