Legal Question in Military Law in Washington

Pay while on annual training

I am an Army Reservist. I have been empolyed with the same company for over 3years. This is the first time that I've been on annual training with this company (I was IRR previously). I had gotten my regular pay along w/ my drill pay w/ my previous employer. Is there a law or something that states I get my regular pay while at AT, since this training is not voluntary? I'm a single mom of 2, and there is no way that I can survive on what I get paid while on AT.

Re: Pay while on annual training

Unfortunately, there is no law here in this state that requires your employer to pay your regular salary while you are attending military reserve annual training. There is the Uniformed Services Employment and Reemployment Rights Act (USSERA), which is a Federal law, but it mainly protects your job, your seniority, and some of your medical benefits. USSERA does not protect your pay check. While its true that some employers will pay while their employees are serving on guard or reserve functions (some even give two or three weeks of paid military leave), none are legally required to do so.
