Legal Question in Personal Injury in Washington

4 person auto accident

the insurance limit is $50.000 policy 1 person was seriously injured medicals bills totalling from hospital stay of 7 days @ 22,000. person 2 has medical 0f $2.500 minor cuts and abrasion. person #3 has medical bills of $5,300 person 4 medical bills are $10,000 serious face laceration all scar are gone. all parties has somewhat recovered all is ready to settle..is there a formular to figure this out fairly.

You should be aware that the $50,000 limit should normally apply to each occurrence, so that each claimant should have up to $50,000 to look at...if the insurance company is trying to sell you a bill of goods that the $50k is available only for all claimants and to be apportioned, I would definitely suggest you have a lawyer look at the policy of the person liable. Also, there may be more insurance available (for example, if it was a commercial entity whose vehicle was involved, you may have recourse against the company's policy AND the driver's policy).

In addition, the claims of the parties should include lost income from work and reduced earning capacity and reduced enjoyment of life. THe age of each claimant and their support obligations to their families are important factors in these regards. Also, if the party liable has resources beyond insurance, your settling at policy limits would prevent you from recoving from other possible sources of money to compensate the victims.
