Legal Question in Personal Injury in Washington
accident where other driver was DUI and hit and run
In August 2004 I was in a car accident where the other driver was witnessed to be drinking at the time of the accident, fled the scene, and was eventually arrested when the cop found him standing next to his smashed up car drinking another beer. I have had neck and back pain since the accident, had to put off my senior year of college for 1.5 years, and my car which had been purchased brand new 3 weeks prior to the accident is worth approximately $4500 with $10000 still owed on it. The accident has severely disrupted my life. I am now 23 years old with chronic pain and instead of a college graduate pursuing a career I am still working to finish my degree. I used all of my PIP for medical treatment and eventually had to stop seeking medical help because I couldn't pay for it. I just received a settlement offer from the at fault insurance company for $6200. I think that this seems ridiculously low given the circumstances. I currently do not have a lawyer. Am I correct that I should receive more compensation, or is the offer that I have received legitimate?

The scope of your damages suggests that a significantly higher award is appropriate. In addition, the alcohol involvement may mean the insurer is likely to pay significantly more. You should retain a competent personal injury lawyer to assist you.
