Legal Question in Personal Injury in Washington

If someone accidently caused harm to another what happens next.

My husband works on a construction site. They are always messing around with each other and throwing tape wadded up into balls as they pass by. My husband lobbed one up to a co-worker that was working above him and instead of hitting the back of his hardhat it hit his eye. The man had a previous eye injury with a nail being lodged into his eye sometime ago, and the tape ball aggrivated the old injury. He said that it tore his eye from the retna. He said to get your ducks in a row because he was not taking an apoligy. What should we do next? Should we offer to pay for his medical?

If your husband was working for the same company as the guy he accidentally injured, USUALLY (but not always), the matter is covered under Workers Comp laws ("L&I" in Washington), and generally that is the ONLY remedy the injured person would have, and he would NOT have a remedy against a co-worker in the same company.

HOWEVER, I would strongly urge you to call a lawyer in your town who handles workers comp (L&I) cases, and ask THAT lawyer, giving more of the particulars of the situation. In fact, it might be worth spending a hundred bucks or so on a consultation, just for the peace of mind; presuming that you get the same answer I just gave you!
