Legal Question in Personal Injury in Washington

auto accident

almost 3 yrs ago i was involved in a auto acc. my back is now stiff and i have pains running down my leg that are all after the acc. the insurance company wants to settle for 2500.00 i see this as unfair but dont want to sue any1. is there a formula or lingo i can use to talk to the opposing company to be treated fairly. ty in advance

If you have pain running down your leg and it's clear that it's from the accident, you need to have a doctor's say-so, in writing, of precisely the condition you have, AND that it's more likely than not CAUSED by the accident. But even if you are armed with this documentation, the insurance company is still not likely to pay you fairly, especially since you're close to the statute of limitations.

Since you are almost at your statute time (3 years), you really ought to just hire a lawyer and have the lawyer file a lawsuit. This doesn't mean you have to go to trial; it just preserves your right to continue to negotiate and settle the case, and to develop the proof you may need to be paid fairly.

The insurance companies rely on your reluctance to sue anyone, and are probably lowballing you because they know it. They're not your friends. Find a good personal injury lawyer in your area and get the claim taken care of professionally.

Don't forget: The WA statute of limitations for an auto accident injury is ordinarly THREE YEARS -- this means that if you haven't filed a proper lawsuit in the appropriate court by the 3-year anniversary of the accident, you may be forever barred from bringing a claim beyond that. And, by the way, the closer to the statute you are, the harder it may be to find a lawyer willing to take the case, so I'd advise not to wait any longer.

That's a ridiculously low amount. The insurance co. is not going to give you more money unless they think you're serious about a lawsuit, and the fact that you've waited to almost the last minute to file a lawsuit tells them that you're not serious.

If I were you, I'd hire an attorney immediately. It'll be too late after the three years are up.
