Legal Question in Personal Injury in Washington
Hit by unlicensed illegal alien
About a year ago I was struck from behind by an unlicensed illegal alien in his van. My family and I were all injured. What factor should the status of the other driver play in the insurance companies settlement offer?

In my experience it's not much of a factor. The most important factors include the nature of the injuries, the extent of medical treatment and the effect of injuries on one's life. If you have any other questions, please feel free to contact me.

My wishes to you and your family for a speedy recovery.
I agree entirely with Mr. Nute. In addition, however, I have a few other comments:
You didn't say whether or not the other driver had insurance. If not, you can sue him as an individual if the driver has assets.
You will probably recover only up to the limits of your own policy if none of the above apply. That's why it's important to make sure you always have adequate insurance coverage of your own.
