Hurt at school on the playground

My son was injured falling from the monkey bars at school. He broke his wrist. This happen on May 11, 2006. His wrist has a slight disformity to it now. I took pictures of the playground. The area right under the playground had padding showing, very much a trip hazard and also had big rocks exposed right under the area my son fell from. The accident reports list the cause of his injure as ''the ground''. The playground has since been fix as a result of me, calling multiple times about it. Their insurance company said they would pay the first 21 days of his injury but not after that. My insurance covered it though. I am on washington state basic health. Does my child have a case, if he were to sue for personal injury?
