Legal Question in Personal Injury in Washington
If you are involved in an auto accident where you were not at fault, and the other driver was cited for fail to yield.Even though I had a current card I had already dropped it the Insurance I was planning to use it as my down payment the next day on a newer vehicle. It was a total.I had pictures taken of the damage before they towed it.My question is can I still file a claim against his Insurance for the loss of my truck?

The short answer is yes, you ought to be reimbursed by the other car's insurance if the accident was clearly the fault of the other driver. If your car was totaled, I suggest you look around on the Internet and the newspapers/Nickel Ads, for comparable vehicles, to figure out how much the car was worth.
That you had no insurance of your own should not affect your property damage claim, although it's possible your driver's license may be suspended for an uninsured accident, regardless of fault. Check with DMV on that, with an anonymous call.
Good luck!
