Legal Question in Personal Injury in Washington

If you are involved in an auto accident where you were not at fault,and the other driver was cited for fail to yield.Even though I had a current card I had already dropped it the Insurance I was planning to use it as my down payment the next day on a newer vehicle.It was a total.I had pictures taken of the damage before they towed it.My question is can I still file a claim against his Insurance for the loss of my truck?
