liability of spouse if unmarried at time of accident?

The other party is sueing my husband and I for injuries from an auto accident I was in. My insurance co. would not settle because the other party waited 2 months to go to the doctor. The summons stated that ''acts done were for the benefit of my marital community'' and other innacurate information regarding the accident. At the time of the accident I was not married (or even engaged). Can my husband be sued? and is it okay for other info in the summons to be inaccurate (ex. stated that i ran into other vehicle when it is clear that he ran into the side of my car)? Thanks

You need to discuss this with your insurance defense counsel. That attorney will be able to address this issue during the litigation. Ordinarily, a person who is not a spouse at the time of the accident, is not a proper defendant. Bear in mind, however, that the plaintiff likely did not know that you were not married at the time of the accident.
