Legal Question in Personal Injury in Washington
I am at a loss. On 4/20/09, I was hit by a teen aged driver, insured through her parents. Treatment lasted until June 2010, but for some reason the lawyers office kept "losing" me with the turn over of paralegals. I wanted to "fire" their office in August 2010, but was persuaded to "hang in there." As of February 2011, the offer from the insurance company is so small, it barely covers my medical expenses, so I instructed them to file suit. To date, I have had emails, letters sent USPS, and phone calls go without response. Their office let me know in February of this year that they would put a lien against me if I left them, as they had received an offer. I do not feel like they are even trying, I could have had my own insurance company do as well, if not better. What recourse do I have now that their office returns none of my correspondence. They won't even answer my question as to whether suit has been filed, yet.

In Washington State, you are allowed to change attorneys at any time without giving a reason. If you are not happy with your lawyer and you can't get the necessary information you are looking for, it is a good idea to retain someone else. The lien issue, if any, would be resolved between your old and new lawyers. Usually, the clients don't have to worry about liens between their attorneys. If a new lawyer takes on your case, he/she will take the lien into consideration.
