Legal Question in Personal Injury in Washington

medical claim before settlement

I was in a hit and run car accident, my insurance is paying medical. I am ready to settle with a settlement of $2500 more than asked for. They have paid all medical bills promptly to this point and I have not reached my $10000 limit. My doctor feels that I should settle. Is the insurance company required to pay all medical bills prior to my settling? Thanks

Re: medical claim before settlement

I do not have enough information about the extent of your injuries, the length of your recovery and other essential facts about your case. Are you still treating with your doctor? Do you have any residual injury or disability? Has your doctor discharged you from any further treatment? Do you have uninsured/underinsured motorist coverage? Have you had any wage loss? If so, how much time and wages have been lost? The $2500 over your medical expenses may be OK or it may be tool low or inadequate. I just do not have enough facts. You have to be mindeful of the statute of limitations, which is 3 years. When did this accident happen? See what I mean? You need to have a comrehensive consultation regarding your case. There is no simple answer to your question. You need to approach this situation with care and deliberation before you decide to settle your case with your insurance company.
