i rent a home from my mother. my husband was working on a car in the garage for a friend, the car was left in the garage for two months with no word from the friend. well a car in the alley got caught on fire no relation to us, but did damage the garage and the front end of the friends car parked in it, neither of us has insurance, my hausband did repair the front end of the car but a burn hole reamins in the top of the car which is a convertable, my husband offered to pay half since the convertable was already damaged and not working, the car 1988 eldorado cadillac two door, the friend took the car back which is fixed and running now wants to take us to court for 4,000, and is suing us and my mother who is the owner of the house, she has insurance, but knew nothing of him working on the car in the first place, so who is resposible? and is the friend intiltled to anything? the value of car accorrding to kelley Blue book is under 1,000.

First, you have to determine if your mother has a homeowner's insurance policy as it is likely that her policy would cover any damage to property stored at the home, including damage to the home. Secondly, the insurance company will likely go after the owner of the car that caught fire. Therefore, if your mother has a homeowner's policy, you should have your husband's friend submit a claim to the insurance company instead of filing suit. Of course, he will still need to show that it actually cost him $4000.00 to repair the vehicle.
