Legal Question in Personal Injury in Washington

Tanning Bed Burns

I am researching a case within our office, which consists of our client suffering severe burns from falling asleep in a tanning bed. He did NOT sign any waiver, nor was he instructed in any way about the use of a bed. The salon has already admitted fault. We cannot find any case law/case history on former cases and cannot arrive at a figure (based on past cases) for damages. Anything about similar cases would be greatly appreciated! I have spent endless hours trying to find something to include within our demand...... please help! Thank you so much in advance!

I presume you're an attorney, or work for one. I'm not sure that the fact that this occurred in a tanning bed changes the damages, unless there is some aggravating factor you think might make the jury angry with the defendant. Other than that, I'd just analyze the damages the same is if it were from an auto accident.

Our office hasn't had any similar claims or damages, but my suggestion is that you connect with your trial lawyer group in Washington, WSTLA (Washington State Trial Lawyers Association). Most members are happy to share their ideas and experience. Even better is their internet listserve. We have one like it here in Oregon, from OTLA. I recently became a member of WSTLA myself, and I've heard very impressive stories about how helpful their listserve is. I'd post the general facts onto the listserve (or have a member friend do it for you, if you're not a member of WSTLA), including total medical bills, wage loss, and of course, prognosis and future impairment.
