Legal Question in Personal Injury in Washington

My wife was involved in an auto accident last year with another partuy at fault. We are trying to get the other party's insurer to make a settlement offer on pain and suffering. They want a HIPAA release signed allowing access to all medical records over the past five years. This contains a great deal of information no one else needs to know. We have no problem releasing data concerning this injury and subsequest treatment. Is it required to release the records they requested?

You are not REQUIRED to release anything to them, if you don't want to. It is up to you, however, the insurance company has the power in this situation. They have the money, and if you want them to make an offer, then you will have to give them what they want.

I recommend that you speak with an experienced car accident attorney. An attorney can guide you through the process and be sure that your privacy is being protected as much as possible.
