Re: bank took back house
Chances are somebody will buy the house today. They have the right to possession twenty days from now. But they have to notify you.
That "notification" is called an unlawful detainer lawsuit. There is a summons and complaint and if you answer there is a court date and they go to court, and get a writ, and the sheriff will post the writ.
The ONLY entity who can make you leave is the sheriff, not the new owner.
Also, there is no authority for the incoming owner to require you to pay "rent" or attorney fees or any other sum of money in order to get the house. If anybody says otherwise they are incorrect.
I'm sorry to hear this is happening to you.
It may be that the bank will get more for your house than you owe on it. If that is the case, the bank has to put the extra money in the court registry and tell you, because the extra money belongs to you.
Hope this helps. Elizabeth Powell
