Re: buying a home

This is not a real property question per se, it's a question for an immigration attorney.

From a real property perspective, the lender does not really care who pays the mortgage nearly as much as they care about getting paid every month on time. So long as you and your lender are on good terms, no one is going to take the house away. And the government isn't going to sieze it, the lender would. The lender would then attempt to re-sell to recoup their costs and your debt. The conditions of default are written into the mortgage instrument.

Hope this helps. But as for your co-owner's status with Immigration, ask your county Bar for a referral to an immigration attorney. They can answer your questions about what happens if the other party has immigration status issues.

Hope this helps. Elizabeth Powell
