After closing, now buyer trying to hold up disbursment, until current tenant mov
We are sellers on a house that is a rental, with a tenant in, that closed yesterday. Today buyers RE agent calls & says buyers are instructing their mortgage co.& the escrow co. to hold funding & disbursing funds til tenant is moved out. That could be 25 days, as they were fully aware. We disclosed that in all papers and disclosures, there was nothing in offer or escrow settlement about money being held until tenants move out. Can buyers's mortgage co., &/or escrow delay like this? We would have to make a mortgage payment to our mortgage co. for a home we don't even own anymore. We feel that this is almost blackmail on their part. We have given tenant legal written notice of sale and have offered to help him move with use of our truck, etc. Thanks for any help, Financially Desperate in WA

Your situation is not susceptible to an answer on thi sservice because the papers need to be reviewed by an attorney to see what was and was not agreed upon and disclosed to all parties. You need to speak to an attorney immediately about this situation and take in all of your paperwork for an in-person review and consultation. That is just about the only way to resolve this matter and get a proper perspective on this case.
