Legal Question in Real Estate Law in Washington
Home owners association
I have lived in my condo since it was new. Recently the home owners association has become very problematic for me. I found out that when we do not attend the meetings any absent home owners count as a yes towards whatever they are voting on. The board is a bunch of retired people who are making my life hell, we are now required to register our car and can only register one car to our parking spot. They deactivated the coded entry to the building and have given board members extra parking spaces. the list goes on and on and I dont know what to do any time we talk to them they just tell us that we have no say in anything anymore. the head guy walks around like he is god and continues to play favorites and give special treatment. Im not sure what to do.

Your answer is closer than you think: as a homeowner, you are entitled to review the bylaws and the operating rules of the HOA, and the minutes of what the new "rulers" have been doing in your absence.
The notion that an absence counts as a yes vote is a novel concept, and I don't know but I doubt it would hold water. You can give a proxy vote to another member or a board member, but assent is not found through a complete lack of conduct.
There are lawyers who specialize in HOA issues. You need to find one who can advise you properly as an individual.
Meanwhile, you can write a registered letter to the supreme ruler and advise him that in ten days or so you are going to review all the books of the HOA.
You are entitled to know what they've been up to. Look at the documents that you signed when you purchased the place for a start.
Best of luck with this - hope this helps. Elizabeth Powell
