Legal Question in Real Estate Law in Washington

mortgage

I went thru bankruptcy in 2003 was divorced in 2004 awarded the house. Ex-husband died in 2006. trying to get his name off mortgage and get the mortgage company to report to the credit bureau. Have diputed with credit bureau they send me back to mortage company who says I have to reaffirm. Bankruptcy attorney says that not necessary to contact a real estate attorney to find out what to do. Can you give me a quick fix that won't cost me an arm and a leg? Want to refinance and can't until the mortgage shows up on my credit report. Have been making all the payments for over four years.

Re: mortgage

Go get a certified copy of your divorce decree and a certified copy of his death certificate.

Was there a quit claim and deed of trust/prom. note concurrent with the dissolution? If so those would be probative of your ownership.

Get together proof that you have been making the payments for four years. Bank statements, cancelled checks, would work.

Your mortgage company will eventually get the picture.

Hope this helps. Eliabeth Powell
