We recently bought a property in Washington. Part of the sale agreement was that repair work be carried out (and paid for) before final sale.

Monies were paid via Escrow to the main contractor for the job.

We are now facing a sub-contractor putting a lein on our house because the main contractor has not paid them and it is up to use (or the main contractor) to pay the bill.

Please can you explain how I can be liable for a bill that I have already paid (through Escrow) to the contracting party?

Who was supposed to pay for the repairs, the seller or you? Who was in charge of the escrow? Did you get title insurance? Were you working through a realty agency or an escrow office?

What a mess. Just know that if a lien is filed without a really good reason you have recourse. You can sue the contractor for allowing this lien to be placed on your real property because you paid for the work but they didn't pay their sub.

You might want to contact L&I about this.
