Legal Question in Real Estate Law in Washington

quick claim deeds

I was informed that a home that still has a loan ongoing may not be quick claim deeded, I was told home must be paid off before doing such a deed? I'm also showing at the recorders office there is no listing as to who the lender is, Most the time the bank would be indicated at the recorders office, why would this be? an error maybe?

Re: quick claim deeds

The description you are looking for is quit claim, not quick claim.

Any real property can be quit claimed to another person by the owner, but the ownership interest does not extinguish the underlying obligation. Houses get quit claimed every day.

The recorders office may or may not have a copy of the deed of trust. The original lender may have sold the mortgage instrument to another lender or financial entity.

Best source of information is your local title company. They can fetch you the deed of trust so you can determine who the lender is.

Hope this helps. Powell
