Legal Question in Real Estate Law in Washington

Removing name from Real Estate

I would like to know how to remove my name from a home loan thru a bank. I have been divorced for 4 years and am unable to remove my name even though all financial responsibility is his thru divorce settlement. He is unable to refiance without my name. Is there ANY other way to remove me from loan?

Re: Removing name from Real Estate

There are only three ways to remove your name from a home loan. First, the house is sold and the loan is paid off. Second, the loan is refinanced in your ex-spuse's name only without your participation in th ematter except for releasing your interest at closing. Third, and this is the most difficult method, you must submit a written request for removal of your name from the note. Banks or lenders are extremely reluctant to do this unless there is another co-signer to take your place or the remaining debtor, i.e., your ex-spouse, is very strong financially. These are your only three options unless you can get your ex-spouse to sign the house back over to you and you coul dsell it if there is enough equity in the house to support a sale and the two of you could divide the profits. This is a variation of option number one. Good Luck!
