Selling a house and wanting to sue for past damage.

My husband & I had damage done to a back bank when the local water system sprang a leak. We believe the leak occurred over a 2-3 year period because of the extent of the damage. The owner of the water system claims the damage was not caused by his water leak. He stated that it had to be from run off. We are being transfered to a new state and want to know if we can still sue while having the house up for sale.

You need to see an attorney right away. There is a three year statute of limitations on neglicence. There is also a "discovery" rule - when you discovered or reasonably should have the damage.
